Abstract
O ensaio, de matriz jurídico-filosófica, busca na literatura de Shakespeare, as
reflexões para ancorar bases teóricas do direito privado, como a relação contratual
fincada no pacta sunt servanda. Pretende com isso, lançar o desafio reflexivo das
premissas do direito civil em ligação a fatos narrados no livro o Mercador de Veneza
escrito no Século XVI. O convite à leitura é para uma aula, cuja narrativa se dá pelas
atuações das personagens.
This philosophical and legal paper, based on the reading of William Shakespeare, searches to analyze and describe private law theories such as contractual relationship, the principle of pacta sunt servanda and its intimate relations with Justice. Shakespeare’s masterpiece “Merchant of Venice” raises circumstances extremely connected with the essential subjects of Private Law theory, which are clear enough to be used as simple examples of the legal institutes here studied and the part that Justice plays in private relations.
