Convenio sobre la libertad sindical y la protección del derecho de sindicación 1948 (núm. 87)

Abstract

El presente trabajo analiza el tratamiento de la libertad sindical en uno de los dos convenios específicos sobre la materia, el Convenio n. 87. Se trata de un texto normativo de extraordinaria importancia dentro del ordenamiento jurídico internacional, ya que recoge y define las facultades que integran la libertad sindical y de asociación, uno de los cuatro derechos fundamentales de la OIT. Tomando como base la doctrina emanada del Comité de Libertad Sindical se analizará el alcance y contenido de la libertad sindical tanto en su dimensión individual como colectiva.The present paper analyses the treatment of freedom of association in one of the two specific conventions on the subject, Convention no. 87. It is a normative text of extraordinary importance within the international legal order, since it includes and defines the basic rights that make up freedom of association as a constitutional principle of the ILO. Based on the doctrine emanating from the Committee on Freedom of Association, we will analyse the scope and content of the rights of this freedom, individual and collective.
