Abstract
La praxis administrativa y la jurisprudencia constitucional en Croacia han sido recientemente enmendadas por el TEDH. Dos derechos estrechamente unidos -la vida familiar y el matrimonio- han sido vulnerados según declara el Tribunal en dos casos distintos. Con estas decisiones, desde Estrasburgo se han ampliado los efectos de las uniones no registradas y se ha reforzado la tutela del ius connubii, al menos en Croacia. Pero queda una situación sin examinar por parte del TEDH y en consecuencia, sin reconocimiento en el ámbito institucional doméstico, incluyendo el TC croata: el “solo matrimonio religioso”. Asimilarlo a la unión no registrada sería una solución justa, siguiendo la jurisprudencia del TEDH. Pero hay otras opciones que también se comentan aquí.
The administrative practice and Constitutional case law in Croatia has been recently amended by the ECHR. Two very close rights -family life and marriage- have been declared to be vulnerated in two different cases. Thus deciding, European Court has enlarged the effects of unregistered unions and fostered the protection of the ius connubii, at least in Croatia. But one situation remains unexamined by the ECHR and consequently, without recognition within domestic institutions, included the Constitutional Court: the “only religious marriage”. Assimilating it to the unregistered union would be a fair solution, following the European case law. But there are other options, also commented here.
