Abstract

This article examines the interaction between the climate emergency and transformative constitutionalism (TC) in its distinct Latin American expression. Since the adoption of new constitutions, and the sweeping reform of existing ones, across the region in the 1980s and 1990s, Latin America’s trajectory in transformative constitutionalism has positioned law as a central instrument for confronting precarious socio economic realities, advancing social inclusion, strengthening the rule of law, and consolidating democracy.
