Abstract
El ocio de los niños y jóvenes del siglo XXI ha cambiado respecto a siglos anteriores. La suma de
deporte, tecnología, ocio y entretenimiento ha tenido como resultado los esports o deportes
electrónicos, en los que participan miles de niños y jóvenes en España, de forma amateur,
profesional o como juego. Son muchos los beneficios y los riesgos del consumo de videojuegos por
menores y de la competición organizada, que se analizan desde un prisma jurídico, estudiando la
legislación vigente para la protección de los menores como profesionales y también como
consumidores y usuarios de este tipo de entretenimiento audiovisual organizado. La segunda parte
de la tesis incluye una investigación cuantitativa cuyo objetivo ha sido analizar los comportamientos
hostiles y los tratos discriminatorios en los esports en jugadores entre los 9 y 17 años, teniendo en
cuenta los diferentes tipos de videojuegos, con la finalidad de averiguar aquellos en los que se dan
mayores conductas tóxicas, así como los patrones de discriminación que suelen guiar estos
comportamientos que son, principalmente, género y raza. Como parte final, entendiendo que la
legislación existente no es suficiente para la debida protección de los menores en los esports, se
proponen una serie de medidas dirigidas a legisladores y responsables de la industria para la
protección de los niños que participan de los esports: actuaciones preventivas, de gobierno y
sancionadoras que protejan la salud mental, el bienestar y los derechos de uno de los grupos de
población más vulnerable.
Children’s and young people’s leisure in the 21st century has changed compared to previous centuries. The combination of sports, technology, leisure and entertainment has resulted in esports or electronic sports, in which thousands of children and young people in Spain participate, either at an amateur level, professionally or as a game. The consumption of video games and the organised competitions of minors bring about many benefits and risks, which are herein analysed from a legal perspective, including a study of the current legislation for the protection of minors as professionals as well as consumers and users of this type of organised audiovisual entertainment. The second part of the thesis includes a quantitative research, whose objective has been to analyse hostile behaviours and discriminatory treatment in esports among players between the ages of 9 and 17, taking into account the different types of video games, with the aim of finding out those in which toxic behaviours are more prevalent, as well as the patterns of discrimination that usually guide such behaviours, which are mainly gender and race. Finally, it being understood that the existing legislation is not sufficient for minors’ due protection in esports, a series of measures are proposed, aimed at legislators and at those in charge within the industry, for the protection of children who participate in esports: preventive, governmental and sanctioning actions that protect the mental health, well-being and rights of one of the most vulnerable population groups.
