Abstract
Las relaciones jurídicas litigiosas entre Estados y empresas en materia de inversiones cuentan con
un procedimiento de resolución extrajudicial de conflictos a través del arbitraje. Se trata del servicio
prestado por el Centro Internacional de Arreglo de Diferencias Relativas a Inversiones (CIADI), que
fue creado por el Convenio sobre Arreglo de Diferencias Relativas a Inversiones entre Estados y
Nacionales de otros Estados, el 18 de marzo de 1965. El CIADI es una institución afiliada al denominado
«Grupo del Banco Mundial», del que también forman parte el Banco Internacional de Reconstrucción
y Fomento (BIRF), la Asociación Internacional de Fomento (AIF), la Corporación Financiera
Internacional (CFI) y el Organismo Multilateral de Garantía de Inversiones (OMGI). En definitiva, el
objetivo del Centro es facilitar la solución de las controversias entre los ciudadanos extranjeros y
las autoridades locales del lugar donde se realizan los negocios mediante el recurso a un procedimiento
arbitral. Para lograrlo, todos los Acuerdos bilaterales de Promoción y Protección Recíproca
de Inversiones (APPRI) contienen mecanismos de resolución de litigios entre inversores y Estados
receptores similares al del Convenio CIADI o se remiten a él. Esto último, unido a un sistema eficaz
de ejecución de los laudos dictados en este contexto, debe servir a los mercados emergentes para
atraer el capital necesario que contribuya a su definitiva expansión.
The international investment disputes between states and companies have a procedural framework of dispute resolution through arbitration. This is the service provided by the International Centre for Settlement of Investment Disputes (ICSID), which was established by the Convention on the Settlement of Investment Disputes between States and Nationals of Other States, 18 March 1965. ICSID is a member of the World Bank Group, which also encompass the International Bank for Reconstruction and Development (IBRD), the International Development Association (IDA), International Finance Corporation (IFC) and the Agency multilateral Investment Guarantee Agency (MIGA). The goal of the Center is to facilitate the settlement of disputes between foreign citizens and local authorities where the business is conducted through arbitration. To achieve this, all Bilateral Promotion and Reciprocal Protection of Investments Treaties (BITs) contain mechanisms for resolution of disputes between investors and States similar to the ICSID Convention or refer to it. The latter, joined to an efficient implementation of awards rendered in this context, should serve emerging markets to attract the capital required to contribute to their final expansion.
